Cohabitation/Marriage Agreements ("Prenups")

In Canada, "prenups" are called Marriage Agreements or Cohabitation Agreements. Without a Marriage or Cohabitation Agreement, the Divorce Act, the Family Law Act, the law of equity, or other legal principles automatically apply when parties separate. We can help you understand the rights and obligations that may result from your relationship by default and guide you in negotiating an Agreement that reflects your mutual intentions. For example, a Cohabitation or Marriage agreement can protect your business, home, cottage, or other property, or create mutual expectations between you and your spouse with respect to finances and support.

Cohabitation Agreements can be prepared to operate as a Marriage Agreement should you marry in the future. And, you can prepare a Marriage Agreement even after getting marriage. In fact, this is sometimes the better approach.
