A Separation Agreement is a formal contract between you and your ex-spouse. It sets out your respective rights and obligations post-separation.

Usually, issues involving property, parenting time, decision-making, child support, spousal support, and other incidences of separation or parenting are addressed.

The initial goal is to negotiate the terms of your Separation Agreement between counsel or parties without the involvement of the court system.

Unfortunately, we regularly see "homemade agreements" that leave one spouse in an unfair position post separation or that are silent on important issues.

A robust Agreement relies on a financial disclosure, negotiation, adequate information for both parties, and legal advice. While you are always free to make your own decisions despite what a lawyer may or may not advise, it is important that you know what your entitlements and obligations may be to have some certainty for the future.
